Deal with Deficiency Judgment Foreclosure

Deficiency judgment order is issued by the courts in order to facilitate the lender to get the difference of amount on the property that has been foreclosed. By issuing this order, the court empowers the lender to collect the money due on the property from the borrower. Judicial Foreclosure:

Judicial foreclosure is the auction of property with court's permit. But, court approves this foreclosure only when mortgage is the actual debt device for the property. In judicial foreclosure, the court sends mortgage-issuing notice to the borrower. In case of non or late response, lender increases loans and associated costs against the borrower. In case, the borrower fails to pay this amount too, the lender appeals to the court to be titled with the authority to trade the property in auction and this way begins the procedure of mortgage deficiency judgment against the mortgagee.

Statutory Foreclosure:

Statutory foreclosure is known as non-judicial foreclosure because this foreclosure does not need court's superintendence. As the contract of the property involves a deed of trust, not mortgage, at times of default payment of the borrower, lender issues a Notice of Default to notify the trustees. In case of such properties, lender, borrower, and the trustee/s sign an agreement and the trustee becomes the warrantor for the property. For this type of property, the lender can held auction of the property with the consent of the trustee. After the sale of the property, an affidavit of foreclosure may have to be registered, again creating a mortgage deficiency judgment against the mortgagee.

Strict Foreclosure:

In several states, where court authorizes the title of the property to the lender on default payment of the borrower without any auction or sale, that foreclosure becomes strict foreclosure. These types of foreclosure are recognized as minor because of their closed availability in a very few states like Connecticut, New Hampshire, and Vermont. It entitles the lender to move to the court and to get an order for the borrower to make up the loan when he defaults. In case, borrower fails to compensate the sum of money on a specific date, the court simply render the property to the lender and issue mortgage deficiency judgment against the mortgage holder.
Therefore, once the lender receives a strict foreclosure, borrower is left with no other alternative than making payment of the deficiency.
